These Terms of Service apply to all freight and logistics services provided by Sandhu Freight & Coatings Pty Limited (ABN 83 703 593 748) of Melbourne VIC, Australia (“we”, “us”, “our”) to you (“you”, “your”). By requesting a quote, placing a booking or using our services, you agree to these Terms.

1. Our services

We provide freight and logistics services, including transport coordination, freight forwarding, warehousing liaison and industrial coatings work, as described on our Services page. The specific services to be supplied to you will be set out in the quote or booking confirmation we issue to you.

2. Quotes, bookings and acceptance

Quotes are valid for 14 days from the date of issue unless we state a different period in writing. A booking is confirmed once we accept your instructions and issue a booking confirmation. You acknowledge that any information you provide about the nature, weight, dimensions, value and handling requirements of goods is accurate and complete, and that we rely on that information when quoting and arranging carriage.

3. Prices, GST and payment

All prices are quoted in Australian dollars (AUD). Unless we state otherwise in writing, quoted prices exclude GST, and GST is payable by you in addition at the prevailing rate where it applies. Our quotes and tax invoices will display our ABN 83 703 593 748.

Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date. We may charge interest on overdue amounts at a rate equal to the Reserve Bank of Australia cash rate plus 4% per annum, and we may suspend services while amounts remain overdue.

Quoted prices are based on the information you supply. If the actual scope of work, weight, volume, access conditions or waiting time differs materially from that information, we may issue a revised quote or a reasonable variation charge, which we will explain before continuing the work where practicable.

4. Cancellations, variations and delays

You may cancel or vary a booking by contacting us at ceo@sandhufreightcoatingsptylimited.online as soon as possible. Where we have already incurred costs in arranging vehicles, subcontractors, coatings materials or site attendance, we may recover those reasonable costs from you. We may also pass on reasonable fuel, toll or regulatory surcharges that apply between the date of your quote and the date of the booking.

5. Your responsibilities

You are responsible for ensuring that:

goods are properly packed, labelled, palletised or crated for safe transport;
all dangerous goods are declared before booking and comply with applicable laws;
load sites provide safe and lawful access for vehicles and personnel; and
you hold all necessary permissions for the goods, including any imported goods.

We may decline, delay or return goods at your cost if these responsibilities are not met or if carriage would breach any law.

6. Transit and delivery timeframes

Any transit time, delivery window or completion date we provide is an estimate only and is not a condition of the contract. Freight schedules can be affected by traffic, weather, road closures, border requirements and third-party carriers. We will keep you informed of significant delays affecting your booking.

7. Consumer guarantees under Australian law

The Competition and Consumer Act 2010 (Cth), including Schedule 2 (the Australian Consumer Law), provides statutory guarantees that apply to the supply of services. Nothing in these Terms of Service excludes, restricts or modifies the application of the Australian Consumer Law, or any guarantee under it, where that exclusion or modification would be unlawful.

However, where you acquire our services for the purposes of a business and the services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, the statutory guarantees may not apply to that supply in accordance with section 64 of the Australian Consumer Law.

8. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, including loss of profit, loss of opportunity or loss of contracts.

Where our liability for a failure to comply with a statutory guarantee under the Australian Consumer Law cannot be excluded and the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, in accordance with section 64A of the Australian Consumer Law, to any one of the following as we decide:

the supplying of the services again; or
the payment of the cost of having the services supplied again.

Nothing in this clause limits your rights to a refund, repair, replacement or other remedy where the Australian Consumer Law requires it.

9. Indemnity, force majeure and general terms

You agree to indemnify us against losses, claims and reasonable costs arising from your breach of these Terms or from inaccurate information you provide, except to the extent caused by us.

We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, industrial action, government restrictions or major network outages.

These Terms, together with any quote or booking confirmation we issue, form the whole agreement between you and us regarding the services. If any provision is held invalid, the remaining provisions continue in force. Our handling of your personal information is described in our Privacy Policy. We may update these Terms from time to time, and the version published on this website at the time of your booking applies.

10. Governing law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.
